How To Handle Yourself If You Get Pulled Over For A Traffic Violation
When you hear the sirens behind you, the first thing to remember is not to panic. Just take a deep breath and pull over as safely as possible. Do not take off your seat belt as you might get a traffic ticket for this as well. Do not open the glove compartment to get your registration. Do keep your hands on the steering wheel so the Officer can see them and roll down your window. Then when he asks for your registration and license, you can retrieve them for him. All of this is done before he decides whether or not to write you a traffic ticket.
Your emotions are all over the place, first you were afraid, now you are praying he is nice. Stop praying because nice has nothing to do with it. He has a job to do and his job is to give our as many traffic tickets as possible and get you to confess to the crime before you speak another word. But now you won’t fall for his trick. He will ask you if you know why it is that he pulled your car over and not another car. At this point you will think to yourself “I don’t want to be a smart Alec and I will appeal to his good nature and say ” ” because I did not fully stop at that stop sign” “. The good news is that the Police officer will in fact not think you are a jerk. The bad news is that you just confessed to breaking the law and he didn’t even have to scare you into confessing. That is why when the Officer asks you anything you say in the most polite possible way “no officer, I don’t”.
You now find yourself watching this person issuing you a traffic ticket. You feel helpless and don’t know what to do. This is the point at which most people make the second biggest mistake. They now admit that they did x, y or z and hope their confession will elicit sympathy from the Police Officer and he will tear up the ticket. It never happens. What he does now is he writes an extra sentence at the end that says in so many words “the defendant admitted to x, y or z without any provocation from the issuing officer”. In lay person terms, you confessed, case closed. If you decide to fight the ticket, the Judge will see this and you are as good as gone. But, if you are smart and follow the instructions below, you won’t fall for these tricks and you will beat your traffic ticket.
If you are going to have any chance of winning in Court, you have to do what is hardest for most people, keep your mouth shut. Don’t start apologizing for what you did. And do not start to argue. If he asks you why you think he pulled you over, tell him “no officer, I don’t”. Don’t be smug about it and don’t be coy, just act innocent. After he tells you why, don’t argue with him. Just take the ticket and move on. The most important thing that the officer needs to remember about his entire interaction with you is that he remembers nothing. That is to say, the whole encounter needs to be unremarkable. You see the faster the whole transaction and the smoother it goes in every respect, the less likely the Police Officer is to show up for court. Also, should the Police Officer show up in Court, it is very unlikely that he will remember anything about the interaction four months later. Thus, if he is challenged by someone in Court about the fact surrounding the stop of your vehicle, he is not likely to remember anything and thus your case is more likely to get dismissed.
